This bill authorizes the Secretary of the Department of Homeland Security (DHS) to adjust the immigration status of Venezuelan nationals who meet specific criteria, granting them the opportunity to obtain Legal Permanent Residency in the United States.

Main benefits of the project

    • Application for permanent residency within the 3 years following the enactment.

    • Exemption from minor grounds of inadmissibility, except for serious crimes or persecution.

    • Automatic cancellation of prior removal orders.

    • Work permit after 180 days with the active application and stay of removals while it processes.

 

Who is it for and what are the requirements?

  • To adjust their immigration status, the applicant must:

    1. Be a national of Venezuela.

    2. Have entered the United States on or before December 31, 2021.

    3. Maintain continuous physical presence for at least one year at the time of application submission (allowing for up to 180 cumulative days of permitted absences). g

    4. Submit the application within three years following the enactment of the law.

    5. Meet the general eligibility criteria for receiving an immigrant visa and be admissible under the INA, subject to specific waivers. 

    6. Not have been convicted of a felony offense, nor of two or more crimes involving moral turpitude (excluding minor political offenses), nor have engaged in persecution.

    Additionally, the same requirements apply to spouses, children, or unmarried minor children of eligible individuals. 

Exclusions under H.R. 1348 (Section 2(b)(3))

Individuals shall not be eligible for this benefit if they:

  • Have been convicted of an aggravated felony (delito grave).

  • Have two or more convictions for crimes involving moral turpitude (delitos de inmoralidad), unless such offenses are minor political infractions.

  • Have ordered, incited, assisted, or participated in acts of persecution on the basis of race, religion, nationality, membership in a particular social group, or political opinion.

My Voice Counts Inc., DBA Comunidad Venezuela is presenting the proposal for the “Venezuelan Adjustment Law” before Congressmen and Senators so that they can be introduced simultaneously in the United States Congress as Sponsors and Cosponsors; namely, before the House of Representatives and the Senate. The following documents received by the constituents will be delivered as support to our petition: signatures, proof of sent emails, proof of phone calls and proof of petition letters sent by fax.

In the same manner, we will send the receipts received from the letters of request, information that will serve so that the presidency is informed of what is being requested to the White House on behalf of the constituents.

By completing the required steps of the petition we can achieve immigration relief for Venezuelan citizens.
